Netproperty Pty (Ltd) – Booking Terms and Conditions
1. General Booking Terms
Confirmation and Payment
To confirm your reservation with Netproperty Pty (Ltd), 100% of the total booking amount must be paid in full. Payment must reflect in our nominated bank account within:
- 3 days of receiving the invoice (for South African bank accounts), or
- 7 days (for foreign bank accounts),
No booking will be confirmed without full payment reflecting in our account, all required documents signed and submitted, and written confirmation issued by the owner or their representative. Netproperty Pty (Ltd) reserves the right to cancel bookings if payment deadlines are not met.
Cancellation Policy
All cancellations must be submitted in writing. The effective date of cancellation is when Netproperty Pty (Ltd) receives the written notice. The following cancellation charges apply:
- 31 days or more before arrival: 50% of total booking value forfeited
- 30 days or less before arrival: 100% of total booking value forfeited
Amendments
Amendments to bookings (e.g., date changes) are at the sole discretion of Netproperty Pty (Ltd) and the property owner. Approved changes may incur additional charges. There is no refund for reducing the length of stay after confirmation, and the nightly rate may increase if dates are changed.
2. Guest Verification & Damage Deposit
A refundable breakage deposit may be charged before arrival. This deposit covers any damage, loss, or extra cleaning required after departure. Guests will be notified of any deductions within 14 working days of checkout.
3. Use of Property
Occupancy
The property is to be used for
holiday accommodation only and may not exceed the number of approved occupants. Written consent must be obtained in advance for any additional guests. Unauthorized occupancy may result in a penalty charge of double the nightly rate or eviction.
House Rules
- No parties, functions, or events allowed
- No smoking indoors – fine of R5,000 will apply
- No pets allowed – fine of R5,000 will apply
- No key duplication without prior consent
- All keys/remotes must be returned at check-out
Guest Responsibility
The main guest is liable for the conduct of all occupants, including invited guests or third-party service providers. Any damage, disturbance, or loss caused will be billed to the main guest.
4. Check-in / Check-out
- Check-in: From 14:00
- Check-out: By 10:00
Early check-ins or late check-outs must be arranged in advance and are subject to availability.
5. Behaviour & Nuisance
Guests must not cause disturbances to neighbours or the surrounding community. Loud music after 22:00 is not permitted. Offensive or disruptive conduct may result in immediate eviction with no refund.
6. Child Safety
Some properties have balconies, steps, or unfenced pools which may pose risks to children. Guests with children stay at their own risk. Children must be supervised at all times around pool areas.
7. Load Shedding & Power Supply
South Africa experiences scheduled power outages ("load shedding"). While some properties may offer backup power solutions (e.g., inverters), their functionality is not guaranteed. Netproperty Pty (Ltd) and owners are not liable for interruptions, outages, or system failures.
8. Internet & Connectivity
WiFi is provided by third-party service providers. Netproperty Pty (Ltd) and owners are not responsible for the speed, uptime, or reliability of the connection.
9. Maintenance & Access
Any concerns or defects must be reported within
24 hours of check-in. Failure to report will be regarded as acceptance of the property’s condition. Reasonable time must be allowed for repairs. Netproperty Pty (Ltd), the owner, or their representatives may access the property for emergency or maintenance purposes with appropriate notice.
10. Additional Services
Third-party services (e.g., chefs, babysitting, tours) arranged through Netproperty Pty (Ltd) are contracted directly by the guest. Netproperty Pty (Ltd) is not responsible for the quality, safety, or performance of these services.
11. Damages & Cleaning
The property must be left in the same condition it was received. Extra cleaning required due to excessive mess may incur additional charges. Lost keys or remotes may result in lock replacements at the guest's expense.
12. Property Descriptions & Photographs
Descriptions and photos are intended as a general guide. Furniture, features, or surroundings may change. No claims will be considered for such changes.
13. Limitation of Liability
Netproperty Pty (Ltd) and the property owner will not be held responsible for:
- Injuries or fatalities on the property
- Loss or theft of personal items
- Load shedding, maintenance issues, or interruptions to services
- Insect/pest presence
- Noise, construction, or disturbances beyond the property’s boundary
- Acts of God (natural disasters, etc.)
Netproperty Pty (Ltd) facilitates bookings between guests and property owners and is not liable if the owner fails to honour the agreement.
14. Disputes & Legal Jurisdiction
This agreement is governed by South African law. Any dispute will be resolved within the legal framework of the Republic of South Africa.
15. Breach of Agreement
If the guest breaches any terms of this agreement, Netproperty Pty (Ltd) or the property owner may cancel the booking and require immediate vacation of the property without refund. Legal action may follow depending on the circumstances.
16. Entire Agreement
These terms, together with the invoice, form the entire agreement between the guest and Netproperty Pty (Ltd). Any variations must be in writing and signed by both parties. If any clause is deemed unenforceable, the remainder remains valid.
By proceeding with a booking, the guest acknowledges and accepts all the terms listed above.
